Welcome to the website of American Legion Post 35 ("Post 35," "we," "us," or "our"), located at 2240 W Chandler Blvd, Chandler, AZ 85224. These Terms and Conditions ("Terms") govern your access to and use of this website (the "Site"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. ABOUT POST 35

American Legion Post 35 is a nonprofit veterans organization chartered under The American Legion. Our facilities, including The Gardens at Post 35, are available for member activities, community events, and private event rentals, subject to our policies and applicable rules of The American Legion.

2. USE OF THE SITE

You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. You agree not to:

- Use the Site in any way that violates applicable federal, state, or local law

- Attempt to gain unauthorized access to any portion of the Site, our systems, or related networks

- Interfere with or disrupt the operation of the Site or servers/networks connected to it

- Upload or transmit viruses, malicious code, or any material that is unlawful, defamatory, obscene, or infringing

- Use automated means (bots, scrapers, etc.) to access or collect data from the Site without our prior written consent

- Impersonate any person or entity or misrepresent your affiliation with any person or entity

3. MEMBERSHIP AND EVENTS

Information on the Site regarding membership eligibility, dues, and requirements is provided for general informational purposes and is subject to the official bylaws and eligibility requirements of The American Legion. Membership is not guaranteed by information provided on this Site and is subject to review and approval according to Post 35 and American Legion requirements.

Event listings, ticket sales, and venue rental information are provided for informational purposes and are subject to change without notice. Registration for events, purchase of tickets, or booking of facilities may be subject to additional terms provided at the time of registration or booking, including those of third-party ticketing platforms (such as Eventbrite).

4. FACILITY RENTALS

Booking Post 35 or The Gardens at Post 35 for a private event is subject to a separate rental agreement, deposit, and facility policies provided directly by Post 35 management. Nothing on this Site constitutes a binding rental agreement or reservation until confirmed in writing by Post 35 staff.

5. DONATIONS AND PAYMENTS

Donations, dues, and ticket payments made through the Site or linked third-party platforms are processed by third-party payment processors. Post 35 is not responsible for errors, delays, or issues caused by third-party payment processing services. All donations are subject to applicable IRS rules regarding charitable contributions where applicable; consult your tax advisor regarding deductibility.

6. INTELLECTUAL PROPERTY

All content on this Site, including text, graphics, logos, images, and the American Legion emblem and related insignia, is the property of American Legion Post 35 and/or The American Legion National Organization and is protected by applicable copyright, trademark, and other intellectual property laws. The American Legion name, emblem, and related marks may only be used in accordance with The American Legion's official licensing and usage policies.

You may view and print content from the Site for personal, non-commercial use only. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written permission.

7. THIRD-PARTY LINKS

The Site may contain links to third-party websites or services (such as Eventbrite, social media platforms, or payment processors) that are not owned or controlled by Post 35. We are not responsible for the content, privacy practices, or terms of any third-party sites. Your use of third-party sites is at your own risk and subject to their respective terms.

8. USER-SUBMITTED CONTENT

If the Site allows you to submit comments, reviews, testimonials, photos, or other content, you grant Post 35 a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with operating and promoting Post 35, including on the Site and our social media channels. You represent that any content you submit does not violate the rights of any third party.

We reserve the right to remove any user-submitted content at our discretion, including content we consider inappropriate, offensive, or in violation of these Terms.

9. DISCLAIMER OF WARRANTIES

The Site and its content are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. 10. LIMITATION OF LIABILITY

To the fullest extent permitted by law, American Legion Post 35, its officers, members, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, attendance at events, or use of Post 35 facilities, even if advised of the possibility of such damages.

11. INDEMNIFICATION

You agree to indemnify and hold harmless Post 35, its officers, members, and volunteers from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site or violation of these Terms.

12. PRIVACY

Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

13. GOVERNING LAW

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Site shall be resolved in the state or federal courts located in Maricopa County, Arizona.
